We may suspend or terminate access to the site or our services for any user we believe is violating these Terms.
Most of the products we supply require a valid, current prescription from a licensed prescriber and, where applicable, prior authorization by your insurer. We will confirm eligibility, coverage, and medical necessity before shipping or delivering equipment. If coverage is denied, we will contact you to discuss options, including self-pay pricing where available.
Products are subject to availability, manufacturer supply, and formulary or coverage limits imposed by your insurer. We may substitute a clinically equivalent product when the prescribed item is unavailable, subject to your prescriber's approval where required.
Delivery timing depends on product type, prior authorization status, and stock. We provide fitting, patient education, and follow-up as required by DMEPOS supplier standards under 42 C.F.R. § 424.57 and applicable state law. Please inspect delivered items promptly and notify us of any issues within seventy-two (72) hours of delivery.
We bill commercial insurance, workers' compensation, and self-pay. We will bill your insurer directly when we participate with them or when you provide out-of-network authorization. You are responsible for co-pays, deductibles, coinsurance, non-covered charges, and any balance remaining after your insurer processes the claim.
For self-pay orders, payment is due at the time of order unless we agree in writing to another arrangement. We accept major credit cards, ACH, and other payment methods identified at checkout. All prices are in U.S. dollars.
Balances not paid within thirty (30) days of the invoice date may be subject to interest at the lesser of 1.5% per month or the maximum rate permitted by Georgia law, plus reasonable collection and attorney fees.
For infection-control, regulatory, and safety reasons, we cannot accept returns of items that are custom-fitted, custom-fabricated, single-patient-use, or otherwise personally used or opened, including CPAP masks, tubing, orthotic and prosthetic devices fitted to the patient, and diabetic testing supplies. This is consistent with DMEPOS supplier standards and infection-control guidance.
If a product is defective on delivery or fails during the manufacturer's warranty period, contact us within seventy-two (72) hours of discovering the defect. We will coordinate a replacement or repair under the applicable manufacturer warranty. This is your sole remedy for a defective product.
You may cancel an order before it ships at no charge by calling 470.945.4558 or emailing [email protected]. Orders that have been shipped, custom-ordered, or fitted are not eligible for cancellation.
The only warranties on products we supply are the manufacturer warranties provided with the product. We pass through and honor those warranties as required by law. Except for the manufacturer warranties, our products and services are provided on an "as is" basis, and we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.
To the fullest extent permitted by law, Archway Medical, its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of our website, products, or services, even if we have been advised of the possibility of those damages. Our total liability for any claim arising out of or related to your use of our website, products, or services will not exceed the amount you paid to us for the product or service that gave rise to the claim in the twelve (12) months preceding the event. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Archway Medical and its members, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of your breach of these Terms, your misuse of our website or products, or your violation of any law or third-party right.
All content on our website, including text, logos, graphics, photography, and code, is owned by Archway Medical or our licensors and is protected by U.S. and international intellectual property laws. You may view, download, and print pages for your personal, non-commercial use. Any other use, including reproduction, distribution, or creation of derivative works, requires our prior written permission.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms, our website, or our services will be resolved exclusively in the state or federal courts located in Cobb County, Georgia, and you and Archway Medical consent to the personal jurisdiction and venue of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, public health emergencies, acts of government, supplier or carrier disruptions, labor disputes, or interruptions to telecommunications or utility services.
We may update these Terms from time to time. When we do, we will change the "Effective" date at the top of this page. Your continued use of our website or services after the effective date of the updated Terms means you accept the changes.
These Terms, together with our Privacy Policy, are the entire agreement between you and Archway Medical concerning your use of our website and services. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, sale of assets, or reorganization.
